Protection Visas (Refugees)

Australia adheres to the United Nations 1951 Convention and the 1967 Protocol concerning the Status of Refugees. Individuals who are determined to be refugees are eligible to receive a protection visa in Australia.
 

A refugee is defined as a person who:
 

  • Is outside their country of nationality or habitual residence.

  • Is unable or unwilling to return or seek protection in that country due to a well-founded fear of persecution based on race, religion, nationality, membership in a particular social group, or political opinion.

  • Is not a war criminal or someone who has committed serious non-political crimes.
     

Here are some visa options to consider:

  • This visa is intended for individuals who arrive in Australia on a valid visa and wish to seek asylum. It grants permanent residency in Australia if the applicant meets Australia's protection obligations and fulfills all other visa requirements.

     

    With this visa, you can:

    ​

    • Live, work, and study in Australia permanently.

    • Sponsor eligible family members for permanent residence through the offshore Humanitarian Program.


    Requirements:

    ​​

    • Engage Australia’s protection obligations (or be a member of the same family unit of someone who does).

    • Have arrived legally in Australia on a valid visa.

    • Meet all other visa requirements, including health, character, and security.

      Application cost: AUD$45.00.

  • These visas are for individuals who arrive in Australia without a visa and seek asylum. They allow temporary stay in Australia if the applicant meets Australia's protection obligations and satisfies all other visa criteria.

    With this visa, you can:

    ​

    • Stay in Australia temporarily for 5 years (Subclass 790) or 3 years (Subclass 785).

    • Work and study.

    • Access government services such as Centrelink.

    ​

    Requirements:

    ​

    • Engage Australia’s protection obligations (or be a member of the same family unit of someone who does).

    • Meet all other visa requirements, such as health, character, identity, and security.

    • Sign a declaration on the application form that you intend to work or study in regional Australia.
