If your visa has been refused or cancelled, you might have the right to apply for merits review.
- Migration and Refugee Division – this division deals with reviews decisions made in respect of general visas (e.g. visitor, student, partner, family, business, skilled visas) and protection (refugee) visas eligible for review under the Migration Act 1958.
- General Division – The AAT- general division handles decisions in relation to business visa cancellations, visa cancellations on character grounds, deportation and citizenship.
The AAT provides an independent and final merits review of decisions made in relation to visas to travel to, enter or stay in Australia.
